Recovery of past CAM overcharges depends on your specific lease terms, including any audit rights deadlines or ‘binding and conclusive’ provisions, and on applicable state law.

State statute of limitations periods apply to written contracts and range from 3 to 10 years. Your actual lookback window may be shorter based on your lease.

I Found Hidden Fees in My NNN Lease

Angel Campa, FounderCAMAudit
Last updated: April 2026

NNN tenants are routinely billed for fees buried in vague lease language: admin markups, management fees on excluded costs, amortized capital improvements, and shared-building occupancy expenses.

TL;DR

Disputing hidden fees requires proving they are excluded under your lease. If the lease language is vague, recovery is harder, but often still possible.

Who this is for

Tenants in NNN or modified gross leases who found line items in their reconciliation that were not clearly discussed during lease signing.

Who this is not for

Tenants in gross leases where CAM is not a pass-through. This scenario is specific to NNN and modified gross lease structures.

What CAMAudit Checks in This Scenario

Rule 2

Excluded Service Charges

Items like executive salaries, depreciation, and leasing commissions are typically excluded from NNN CAM per lease definition.

Rule 3

Management Fee Overcharge

Admin fees and management markups are often charged on top of the disclosed management fee, inflating CAM.

Rule 12

Common Area Misclassification

Capital improvements and building-wide expenses are misclassified as common area operating costs.

Rule 1

Gross Lease Charges

For tenants with hybrid leases, certain components may be covered by base rent but billed again through CAM.

What to Do Next

  1. 1Request the full expense ledger with backup documentation for every CAM line item.
  2. 2Compare each line item to your lease's CAM definitions and exclusion schedule.
  3. 3Run CAMAudit to identify which of the 14 detection rules flag the fees you found.
  4. 4Calculate the total overcharge across the full lookback period (up to 6 years in most states).
  5. 5Issue a dispute letter draft itemizing each unauthorized fee with the relevant lease clause cited.
  6. 6If the lease language is ambiguous, consult a commercial real estate attorney before escalating.
